Woman’s death causes traffic collision case to be reopened

PORT ANGELES — A woman involved in a May 5 wreck has died nearly two months after the incident, and police are investigating to help Clallam County Prosecuting Attorney Deb Kelly decide if charges are warranted.

Marylee “Mim” Foley, 71, died June 17, about 1 ½ months after she was injured in a wreck at Park Avenue and Race Street in Port Angeles.

Foley was driving southbound on Race Street when a car driving east on Park Avenue passed a stop sign and hit Foley’s car, said Deputy Chief Brian Smith.

The driver of the other car was a juvenile, so Smith declined to release the girl’s name. The models of the cars were not available.

The girl was given a ticket for failure to stop at the time of the wreck, he said.

“She took care of that citation the very next day,” Smith said.

Because Foley might have died of injuries related to the wreck, the case has been reopened, Smith said.

At the time of the collision, it appeared that Foley had hip injuries and a sore neck, but those injuries later progressed, Smith said.

“We will wait for a corner’s report to determine what other factors might have been at play,” he said.

Other charges are sometimes filed in crashes that result in a fatality if there is wanton disregard for the safety of others.

“In this case it was a driving error that is commonly committed and unfortunately resulted in a death in this case,” he said.

“Although we are forwarding the case to the prosecuting attorney and other charges could be fined, it doesn’t not create the expectation that there will be.”

Kelly said she is waiting for the rest of the file from the Police Department and will determine if charges will be filed after she reviews the information.
