PORT TOWNSEND — Opponents of fluoridating Port Angeles” public water supply have asked the judge who threw out their lawsuit to rethink his decision.
Protect the Peninsula’s Future and other parties filed the motion for reconsideration Monday in the Jefferson County Superior Court of Judge Craddock Verser.
Verser on Sept. 1 threw out their claim that the city must adhere to the state Environmental Protection Act.
He ruled that the city was exempt from the law even though it had conducted an environmental review.
Protect the Peninsula’s Future, its founder, Dr. Eloise Kailin of Blyn, and Clallam County Citizens for Safe Drinking Water had sought a full environmental impact statement on the plan to add fluoride to the city’s water
Verser dismissed the action “with prejudice,” meaning it cannot be refiled.
