PORT TOWNSEND — One charge against former Chimacum High School Principal Rex Whipple was dismissed during his Jefferson County Superior Court trial Wednesday.
Judge Craddock Verser dismissed a charge of sexual exploitation of a minor after hearing arguments on a motion from Defense Attorney Alton McFadden that all charges be dismissed.
The judge let stand 10 charges of possessing depictions of a minor in sexually explicit conduct and ordered the trial to proceed.
“I’m not surprised,” Jefferson County Prosecuting Attorney Juelie Dalzell said about the dismissed charge.
McFadden’s “arguments were legally correct.”
The trial, which begins its fourth day today, will resume at 9 a.m. in the courtroom at 1820 Jefferson St.
Whipple, 46, is accused of surreptitiously videotaping his 15-year-old stepdaughter in various stages of undress from outside her bedroom window in their Port Ludlow home.
He is expected to testify today as the defense continues its case.
Dalzell rested her case on Wednesday.
