PORT LUDLOW — The $10.7 million lawsuit filed against Port Ludlow Associates’ parent company will resume in San Francisco Superior Court next month.
A hearing is set June 3 to restart the case.
Proceedings had stopped in the matter three months ago when HCV Pacific Partners filed for bankruptcy protection under Chapter 11 of the federal bankruptcy code.
Bankruptcy Judge Dennis Montali threw out the bankruptcy filing earlier this month.
With the filing out of the way, the suit can proceed, attorney Richard Katz said Tuesday.
His client, Gerald “Jed” Boscoe of Seattle, had claimed that HCV filed for bankruptcy to derail the lawsuit.
Lawsuit over payment
Boscoe filed the suit in August 2000 seeking money he believes the company and its chief executive officer and president, Randall J. Verrue, are contractually bound to pay him.
HCV officials have not returned calls seeking comment since the bankruptcy filing was dismissed.
In the past, Verrue has called the suit an “egregious claim.”
