Judge: Davis unfit for assault trial

PORT ANGELES — A Silverdale man charged with the attempted murder and assault of a Clallam County deputy has been found to be mentally incompetent to stand trial and ordered into treatment.

Clallam County Superior Court Judge Ken Williams on Tuesday ordered the state Department of Social and Health Services to place Scott Lincoln Davis, 59, in Western State Hospital in Tacoma to undergo treatment for up to 15 days.

If, after the treatment, Davis is still mentally unfit to stand trial, he could be placed in a mental health facility indefinitely.

Davis is charged with the attempted murder and assault of Clallam County Sheriff’s Deputy Bill Cortani during a shoot-out on Jan. 19 near Sekiu.

Cortani, 41, of Forks, was shot in the arm and hip. Davis was shot in the stomach and left arm.

Williams postponed Davis’ trial on March 20 to undergo a mental evaluation at Western State Hospital.

Court records did not list Davis’ mental disorder.

A review hearing is set for 1:30 p.m. Friday.

Davis remained in Clallam County jail Wednesday in lieu of $500,000 bond.

The Forks lawman was attempting to arrest Davis on investigation of trespassing near Sekiu after the Sheriff’s Department was told that the man was squatting in a beachfront cabin on state Highway 112 near Milepost 7.

Davis shot at Cortani with a handgun, and the deputy took cover behind logs and driftwood on the beach.

Davis fired his gun until it was empty, then retrieved a double-barrel shotgun from his car and pointed it at Cortani.

Cortani shot back and incapacitated Davis.

Both men were taken to Harborview Medical Center in Seattle.

Cortani was discharged from the hospital the next day and has since returned to work.

Davis was released after a few days in the hospital under State Patrol guard and was immediately booked into the Clallam County jail.

Davis retired from the Army with the rank of major in 1991, according to his resume, which was posted online.

He had worked at the Central Kitsap School District until 2005, when he served as a recreation park manager for the U.S. Navy in the Bremerton area.

He began military service in 1971, his resume said, and earned a Bronze Star, three Meritorious Service Medals, three Commendation Medals, a Ranger Tab and a Senior Rotary Wing Aviator, his resume said.
