PORT ANGELES — A political hopeful who was released from a King County jail Thursday could still officially become a candidate for Clallam County’s top criminal prosecutor if he meets today’s deadline.
David R. Fox was released without bail after the King County Prosecuting Attorney’s Office failed to file charges within 72 hours after his arrest late Sunday evening at Seattle-Tacoma International Airport.
Airport police arrested him for investigation of driving while intoxicated, possession of marijuana and drug paraphernalia and possession of prescription drugs without a prescription.
The 49-year-old Port Angeles resident is an announced candidate for Clallam County prosecuting attorney.
The filing period for candidates began Monday and ends at 4:30 p.m. today. Fox, a Democrat, did not file while he was in jail, or Thursday after he was released.
Incumbent Deb Kelly, a Republican, and Democrats Larry Freedman and Lauren Erickson have filed as candidates for the office.
Leesa Manion, chief of staff for King County Prosecuting Attorney Dan Satterberg, said charges have not been filed because the office is awaiting the results of a toxicology test and other reports.
“We’ll wait until we get the entire case and review it and make a decision at that time,” she said.
The reports could take a couple of weeks to complete, Manion said.
The arrest came a few minutes after Fox allegedly displayed a sheathed knife to a ticket agent at the airport.
Airport police who stopped his truck as it was leaving the check-in drive said he was intoxicated.
Seven grams of marijuana, a marijuana pipe and two prescription drugs — an antidepressant and an anxiety reliever — were found in the truck, Port of Seattle police said.
Two days before the arrest, the state Attorney General’s Office said it would not file charges against Fox after investigating allegations of sexual misconduct with a former client and introduction of contraband into Clallam County jail.
Fox could not be reached for comment Thursday.
