The American people had just fought a revolution when the Constitution was written to meet their demand for a clear and unambiguous contract with the government.
Then President Woodrow Wilson, a Progressive, claimed the constitution was a ‘living document’ and ‘evolved’ over time. Progressive judges have ‘interpreted’ the Constitution based on his theory ever since.
Judge Ginsburg, a Progressive, thought so little of it that she recommended in 2012 the Egyptians use South Africa’s and other 20th Century models.
Imagine you bought a car from your local dealer and a few weeks later the engine fails. Then imagine the dealer tells you that, while your contract had said the motor was guaranteed, the contract had ‘evolved’ since then and the motor was not protected.
That is what happened to Socialist Charles Schenck in 1919 when the Court decided that free speech did not include speaking against the draft and Justice Holmes made his famous ‘yelling fire in a crowded theater’ analogy.
What an American ‘said’ could be controlled by the government if they didn’t like it and if the Supreme Court agreed, even though it was just their opinion. Fortunately, that decision was reversed by strict constructionists in 1969.
Strict constructionists believe the people have the right to amend the constitution.
Progressives relieve the people of that burden and make the changes they think necessary for us.
The next president may appoint up to three justices to the Supreme Court. Trump has vowed to appoint traditional strict constructionists. Biden has said he will appoint Progressives.
