PORT ANGELES — Danette Denise Gilbert has been sentenced to seven years, nine months in prison for shooting at a roommate through a door of a Lower Elwha Road residence, Clallam County prosecutors announced.
Gilbert, 50, pleaded guilty to first-degree assault as an act of domestic violence Tuesday. She was sentenced to 93 months in prison, prosecutors said.
The Clallam County Sheriff’s Office said Gilbert shot at a man with a Remington model 1903 .30-06-caliber rifle at his Lower Elwha Road home on Aug. 12.
The landlord told investigators that Gilbert was angry about her television being damaged and that she blamed the man for the damage, according to the affidavit for probable cause.
The man told investigators that Gilbert had entered his house while he was sleeping and began screaming at him about her belongings, Sgt. James Dixon said in the arrest narrative.
He told investigators that Gilbert retrieved the rifle from a vehicle after he pushed her out the door.
“[He] held the door closed and said that Danette [Gilbert] told him she was going to count to three, then shoot,” Dixon said in his report.
“He said when she started counting, he stepped away from the door and into the kitchen. He said when she got to three, she fired a bullet through the door. [He] said if he had not moved from the door he would have been shot.”
The landlord, who was staying near the residence and heard the gunshot, corroborated the victim’s account.
The rifle was found under a trailer adjacent to the home.
Gilbert was prohibited from possessing firearms from a past heroin conviction, Dixon said in the arrest narrative.
Gilbert was originally charged with attempted first-degree murder with domestic violence and firearm enhancements.
She pleaded guilty to first-degree assault with domestic violence Tuesday.
Gilbert was being held Thursday at the Washington Corrections Center for Women.
She will be under state supervision for three years after her release.
“This resolution is consistent with the Clallam County Prosecutor’s Office’s position to prosecute felony firearm offenders aggressively,” Chief Criminal Deputy Prosecutor Michele Devlin said in a news release.
