PORT ANGELES — A former Clallam Bay Corrections Center inmate has been sentenced to more than four years in prison for throwing urine on two corrections officers in August 2013.
Terrence Lynn Lavery, 44, was convicted of two counts of third-degree assault Jan. 31. He was sentenced Tuesday in Clallam County Superior Court to 56 months.
Lavery, formerly of Seattle, has been serving time for a robbery conviction. He was scheduled to be released from prison this spring, Clallam County Deputy Prosecuting Attorney Jesse Espinoza said.
Lavery’s new sentence will begin only after he completes the robbery sentence, Espinoza said.
The Clallam County Sheriff’s Office said Lavery tossed urine through the mail slot in his cell, splashing two officers, and said: “How you like that piss, punk?”
Officers Stephen Monger and Jacob Martin told Clallam County sheriff’s investigators that they were delivering meals to prisoners in the Intensive Management Unit when they were splashed with a fluid, according to the affidavit for probable cause.
Monger told Clallam County Sheriff’s Sgt. Edwin Anderson that he felt something hit his left arm, shirt and pants, court papers said.
“Officer Monger said that the fluid wasn’t cold like water and wasn’t yellow but it did smell a little funny,” Anderson wrote in the probable cause statement.
Based on his offender score, Lavery faced a standard sentencing range of 51 months to 60 months, Espinoza said.
Clallam County Superior Court Judge Christopher Melly imposed the 56-month sentence and ordered Lavery to serve one year of community custody after his release.
Defense attorney Alex Stalker filed Tuesday a motion to pursue an appeal on Lavery’s behalf.
Lavery was being held Friday at the Monroe Correctional Complex.
